missing with a fight skill

You slash an ivory seagull extremely hard.
An ivory seagull misses you with its bite.
You slash an ivory seagull very hard.
An ivory seagull is incapacitated and will slowly die, if not aided.

You massacre an ivory seagull to small fragments with your slash.

The question I have is, how do I manage to miss a kick at a bird lying incapacitated on the ground? I would think the chances of success on a stunned/incapacitated/whatever mob would be about as close to 100% as you can get. I've noticed this quite often and it seems the success of a skill is not affected in any way by the status of the mob.

heh yup, it's funny doing the same thing with a flail on a morted mob - you even hit it with the flail and it still doesn't die, then a tick passes and the mob gets up and beats another 300+hp out of you before going down again. That happens quite often too btw.
